These Terms and Conditions apply to services provided by Weather365 through its website, located at Weather365.com, including subdomains, API, and mobile applications (the “Services”).

By clicking “I agree” or by using the Services, you are agreeing, or if you are agreeing on behalf of an entity, the entity is agreeing, to be bound by the Terms and Conditions. If you later disagree with the Terms and Conditions, you agree to stop using the Services and contact Weather365.

1. Using the Services

Under no circumstance should data be copied from this site through mining, downloading, scraping, or any type of gathering without prior permission.

Data may not be electronically gathered from our website in any way other than the official data download or data feed pages. (except for indexing purposes by web search engines that direct traffic to our website)

Purchase of a data download or data feed is considered permission to use the data for your own personal or in-house use without limits.

Use of the free data feed is also considered permission to use the data for personal or in-house use without limits.

Commercial or resale of the data is not allowed in any form if no value is added. ie: You can't echo our data to others in any way that generates income including but not limited to a website with click ads.

Commercial use of our data is allowed if you are using our data as a base and adding additional information, content, or service value to the data AND you are not selling the data in bulk.

Our goal is to provide data to the public, application developers, and commercial entities in a reasonable and fair way. We are very flexible on how the data is used by others as long as we are treated fairly in the process and receive fair credit and compensation for the data collection efforts we put in.

2. Unauthorized Use

You agree to not: 

(a) Use any bot, spider, or other automated scripts, program, software, process, or technology to scrape, data mine, download, copy, extract, or otherwise collect content from the Services, except in connection with your use of the API Services; 

(b) Circumvent or reproduce the look and feel of the Services; 

(c) copy, damage, decompile, disassemble, disrupt, impair, modify, or reverse engineer the Services; 

(d) use the Services to violate any law or regulation in any jurisdiction; 

3. Intellectual Property Rights

Weather365 reserves all rights, titles, and interest in the Services and Product Data including, but not limited to, all copyrights, patents, trademarks, trade secrets, industrial designs, utility models, and any other rights recognized pursuant to the laws of any country or jurisdiction, whether or not protected by law. Without limiting the foregoing, Weather365 retains all rights not expressly granted in the Terms and Conditions.

Certain elements of Product Data, such as product images and descriptions, are the property of third parties. The Terms and Conditions do not grant you any rights to Third Party Content and you represent and warrant that your use of Product Data will not infringe the rights of any Third Party Content owner. If you require rights to Third Party Content please contact the Third Party Content owner.

4. Privacy

Your privacy is important to us. Please read our Global Privacy Statement and Cookie Statement for information regarding how we collect, use, and disclose your personal information and the privacy rights available to you when you use and interact with the Service.

For privacy and data protection laws, for much of the personal information we process when providing the Service, we act as your processor or service provider. However, there are certain instances, as more fully described in our Global Privacy Statement, where we process personal information, including Content and other data from Member accounts, as a controller to provide and develop the Service and for other important business purposes (e.g., for billing, administrative, security, and product improvement purposes). 

As described in our Global Privacy Statement, this includes sharing such information with our parent entity, and its group companies to provide, develop, and improve other Intuit products and services that you connect through the Service or otherwise use by the applicable Intuit terms of service, including to provide you with greater insights about your business and to personalize your user experience within our platform.

5. Updates

Weather365 reserves the right, in its sole discretion, to modify the Terms and Conditions and Privacy Policy at any time (“Updates”). Weather365 shall notify you of Updates by making them available at www.Weather365.com/terms-of-use. You are deemed to accept any Update by continuing to use the Services. Unless Weather365 states otherwise, Updates are automatically effective right after posting on www.Weather365.com.
